This Deed made this Thirteenth day of Augt in the Year of our Lord One thousand Eight hundred and Eight Between John Howarth and Tryphosa of the one part and Zachariah Crocket of the same place of the other part. Witnesseth That the said John Howarth and Tryphosa his wife for and in consideration of the sum of Three hundred and fifty Dollars to them in hand paid and secured to be paid by the said Zachariah Crocket at and before the ensealingand delivery of these presents Which is hereby Acknowledged, Have granted, bargained and Sold and by these presents they and each of them do grant, bargain sell alien enfeoffe and confirm unto the said Zachariah Crocket his heirs and Assigns for ever, al that tract or parcel of land which the said John Howarth purchased of Abel West as will appear by the deed of conveyance now of record in the County Court of Accomack bearing date April 1st 1805. The said Land being a part of the Island called Black Walnut Island beginning from the narrows down to the place called Oak Hammock containing one hundred and Sixty Acres be the same more or less as will more fully appear by the said deed reference being thereto had together with all the rights priviledges, and appurtenances to the said tract of Land above described belonging on in any wise appurtaining To have and to hold the said above described tract of Land with all the hereditaments rights, priviledges and appurtenances thereunto belonging and every part & parcel thereof unto him the said Zachariah Crockett and his heirs and assigns for ever free from the claim or claims of them & each of them their and each of their heirs and from the claim of all and every person whosoever shall & will warrant, and by these presents for ever defend. In Testamony whereof the said John Howarth and Tyrphosa his wife have hereunto set their hands and affixed their Seals this day and Year first before written

The Commonwealth of Virginia William Parramore Senr, John Burton and John Custis Gentlemen Justices of Accomack County, Greetings whereas John Howarth and Tryphosa his wife have by their certain deed of bargain and sale, bearing date the 13th day of August in the Year of our Land one thousand eight hundred and Eight sold and conveyed unto Zachariah Crocket a Tract of Land on Black Walnut Island containing by estimation one hundred and Sixty Acres be the same more or less, with the appurtenances lying and being in the County of Accomack beginning from the narrows on said Island and running down to a place called Oak Hammock. And where as the said Tryphosa Howarth cannot conveniently travel to our District Court holden at Accomack Courthouse, to make acknowledgment of the said deed: therefore we do give unto you or any two or more or you power to receive the acknowledgment which the said Tryphosa Howarth shall be willing to make before you of the conveyance aforesaid, contained in said Deed, which is hereto annexed. And we do therefore command you, that you do personally go to the said Tryphosa Howarth and examine her privily and apart from her husband John Howarth whether she doth the same freely and Voluntarily without his persuasions or threats; and whether she be willing the same should be recorded in our said district court and receive her acknowledgment of the same, and when you have examined and received her acknowledgment as aforesaid, that you distinctly and openly certify to us thereof in our said Court, under out Seals, sending then there the said deed and this writ. Accomack County to Wit.
By Virtue of this commission to us directed we the Subscribers have privily examined Tryphosa Howarth the wife of the within named John Howarth in manner and form as the said commission requires, and have received her acknowledgment of the deed hereunto annexed, which said deed she acknowledged freely and Voluntarily without the persuasion or threats of the said John Howarth her husband and that she was willing the same should be recorded in the District Court directed by law to be holden at Accomack courthouse, which we do certify to the said Court, under our hands and Seals this 13th day of August one thousand eight hundred and Eight
