This Deed made this Tenth day of October in the year of our Lord Seventeen hundred and ninety Eight Between Smith Milliner and Nancy his wife, Major Guy and Rachel his wife, Ann Melson (widow of Levin) and Rosey Melson, Middleton Melson and Rosey his wife, and John Melson and Betty his wife children and heirs of Lancy Melson decd of the one part & and John Welburn of the other part, all of the County of accomack in the State of Virginia. Witnesseth that the said Smith Milliner and Nancy his wife, Major Guy and Rachel his wife, Ann Melson (widow of Levin) and Rosey Melson, Middleton Melson and Rosey his wife, and John Melson and Betty his wife for and in consideration of the sum of one hundred and Sixteen pounds one Shilling current money of Virginia to them in hand paid by the said John Welburn the receipt whereof they do hereby by acknowledge and wholly discharge the said John Welburn therefrom, Have granted bargained and sold aliened enfeoffed released and confirmed unto the said John Welburn his heirs and assigns for ever four undivided fifth parts of a certain Tract or parcel of land with the appurtenances which descended to the said grantors by the death of a certain Southy Milliner their relation, lying and being in the Parish and County of Accomack and bounded as follows by the lands of Selby Simpsons heirs on the North, and by the lands of John Moore on the East, by the lands of John A. Bundick on the South and by the County road on the West containing in the whole Twenty eight acres more or less together with all the right and title of the said grantors which they now have or hereafter may have to the said premises. To have and to hold the said hereby granted and Bargained and sold four undivided fifth parts of the said premises with the appurtenances unto him the said John Welburn his heirs and assigns for ever and to and for no other use intent and purpose whatever but the only proper use benifit and behoof of him the said John Welburn his heirs and assigns forever. And the said Smith Milliner and Nancy his wife, Major Guy and Rachel his wife, Ann Melson, Rosey Melson, Middleton Melson and John Melson do for themselves and each of them jointly and severally and their Heirs covenant and agree to and with the said John Welburn his heirs and assigns against themselves and each of them their heirs and all persons claiming under them or either of them the aforesaid four undivided fifth parts with the appurtenances will warrant and for ever defend by these presents. The Commonwealth of Virginia to Thomas Custis John Teackle Senr & John Cropper Jr. Gentlemen justices of Accomack greetings: Where major Guy & Rachel his wife, Ann Melson, Rosey Melson, Middleton Melson & Rosey his wife, John Melson and Betty his wife & Smith Milliner and Nancy his wife have by their certain Deed of bargain and Sale, bearing dat the tenth day or October in the year of our Lord one thousand seven hundred and ninety Eight sold and conveyed unto john Welburn twenty eight acres of land more or less with the appurtenances lying and being in the County of Accomack and bounded to wit by the lands of Selby Simpsons heirs on the north, and by the land of John Moore on the East, by the lands of John A. Bundick on the south and the County road on the West. And whereas the said Rachel, Rosey, Betty & Nancy cannot conveniently travel to our District Court to be hold at Accomack Courthouse to make acknowledgement of the said Deed, therefore we do give unto you or any two or more of you power to receive the acknowledgement of the same, and when you have examined and received their acknowledgement as aforesaid, that you distinctly and openly certify to us thereof in our said Court under your Seals, sending them there the said Deed and this writ. By virtue of the within Commission to us directed we the Subscribers have privily examined Nancy Milliner, Rachel Guy, Rosey Melson and Betty melson the wives of the said Smith Milliner, Major Guy, Middleton Melson & John Melson in manner as the said Commission requires and have their acknowledgments of the Deed hereto annexed, which said Deed they acknowledged freely and voluntarily without the persuasions or threats of their said Husbands and tat they were willing the same should be recorded in the District court held for Accomack and Northampton next, which we do certify to the said Court under our hands and Seals this 16th day of October 1798

At a district Court held at Accomack Courthouse October 18th 1798 this Deed from Smith Milliner and Nancy his wife, Major Guy and Rachel his wife, Ann melson, Rosey melson, Middleton Melson & Rosey his wife and John Melson and Betty his wife to John Welburn was proved by the Oaths of Thomas Custis, John Cropper Jr. And Edmund Bayly Witnesses thereto and together with a Commission annexed and certificate of the execution thereof being returned are ordered to be recorded.
