Deed from William Schoolfield and Rosanah, his wife, to Thomas Bayly - Transcribed by Gail M. Walczyk

This Indenture mad this 23rd day June in the Year one Thousand eight Hundred Between William Schoolfield and Rosanah his wife of the county of Worcester State of Maryland of the one part and Thomas Bayly of the County of Accomack State of Virginia of the other part Witnesseth the said William Schoolfield and Rosanah his wife for & in consideration of Nine hundred Dollars lawful money of the Untied States to them in hand paid by the said Thomas Bayly before the ensealing and delivery of these presents (the receipt whereof is hereby acknowledged) Have bargained and Sold and by these presents do bargain and sell unto the said Thomas Bayly his Heirs and assigns a certain tract of Land containing eighty three acres mor or less lying in Accomack county and near the Courthouse which Land desended to the said William Schoolfield and Rosanah his wife in right of the said Rosanah by the death of Elizabeth Parker daughter of Thomas Parker Decd and which Land has been confirmed to the said William Schoolfield & Rosanah By a Deed of partition heretofore made between William Schoolfield & Rosanah his wife John Parker & Ann his wife and George Parker together with all and singular the hereditiments and appurtenances unto the said above discribed land belonging or appertaining and every part and parcel thereof To have and to hold the sd land unto the sd Thomas Bayly his Heirs & Assigns for ever to and for the only proper use and behoof of him the said Thomas Bayly his heirs & assigns for ever. And the said William Schoolfield and Rosanah his wife for themselves and their heirs the said land with all & Singular the premisses and appurtenances before mentioned unto the said Thomas Bayly his Heirs and Assigns free from the Claim or Claims of then the said William Schoolfield and Rosanah his wife or either of them their or hither of their heirs and all persons whatsoever shall will and do warrant and forever defend by these presents In witness whereof the said William Schoolfield and Rosanah his Wife have hereunto set their hands & Seals the day & Year first above written

The Commonwealth of Virginia to William Downing Jno S. Ker & Walter Bayne Gentlemen Justices of Accomack Counyt Greetings: Whereas William Schoolfield and Rosanah his wife have by their certain indenture of bargain and sale bearing date the 23rd day of June in the year of our lord one thousand 800 sold and conveyed unto Thomas Bayly Eighty three Acres with the appurtenances lying and being in the County of Accomack and bounded, to wit as will appear by Deed Annexed, And whereas the said Rosey cannot conveniently travel to our District Court to be holden at Accomack courthouse to make acknowledgement of the said Indenture, therefore we do give unto you or any two or more of you power to receive the acknowledgement of the said indenture therefore we do give unto you or any two or more of you power to receiver the acknowledgement which the said Rosey shall be willing to make before you of the conveyance aforsd contained in said indenture which is hereto annexed, and we do therefore command you that you do personally and appart from her said husband William Scoolfield wheither she doth the same freely and voluntarily withou his persuasions or threats and whether she be willing that the same Should be recorded in our said District court and receiver her acknowledgement of th same and when you have examined and received her acknowledgment as afsd that you distinctly and openly Certify to us thereof in our said court under your Seals sending them there the said indenture and this writ Witness Edmund Bayly, clerk of our said court at the courthouse the 23 day of June in the 24 Year of the Commonwealth

By Virtue of the within Commission to us directed we the subscribers have privily examined Rosey the wife of the said William Schoolfield in manner in the said Commission requires and have received her acknowledgement of the indenture hereto Annexed which said Indenture she acknowledged freely and voluntarily without the persuasion or threats of the said William Schoolfield her Husband and that she was willing the same should be Recorded in the District Court of Accomack which we do Certify to the said court under Our hands and Seals thsi the 23rd day of June 1800
