This Indenture made this fourteenth day of December Anno Domini one thousand
seven hundred and eighty nine Between William Polk of the county of Accomack Virginia
of the one part and John Custis Bayside of the same place of the other part Witnesseth
that the said William Polk for and in consideration of the intents trusts and purposes
herein after mentioned and for the further consideration of five shillings to him
in hand paid by the said John Custis at and before the ensealing and delivery of
these presents the receipt whereof is hereby acknowledged hath given granted bargained
and sold and by these presents do give grant bargain and sell alien enfeoff and confirm
to the said John Custis his heirs and assigns forever a certain tract or parcel of
land situate lying and being in the County of Accomack and parish of Saint George
in Bradford's Neck being part of that tract of land that lately fell to the said
William Polk by the death of his son Nathaniel Polk To have and to hold the said
one hundred acres of Land together with the appurtenances unto the said John Custis
his heirs and assigns forever for no other use intent or purpose whatever but the
following to wit, first & principally to secure to the said John Custis his heirs
and assigns the payment of one hundred and three pounds thirteen shillings and seven
pence current money of Virginia whit legal interest thereon from the date of these
presents together with the Costs and expences on recording this Mortgage and [-----]
the over plus if any for the only proper use benefit and [-----] of the said William
Polk his heirs and assigns and the said William Polk doth hereby for himself his
heirs Executors and Administrators covenant and agree to and with the said John Custis
his heirs and assigns that in case the aforesaid sum of money together with interest
thereon and the Costs aforesaid is not punctually paid on or before the fourteenth
day of December seventeen hundred and ninety one that then it shall be lawful for
the said John Custis his heirs and assigns to enter and take possession of the said
one hundred acres of land together with the appurtenances and make sale of the same
for the payment of the said Debt interest and Costs returning the overplus if any
to the said William Polk, and that the said William Polk will confirm the sales aforesaid
and warrant and defend the title of the said Lands together with the appurtenances
unto the purchaser or purchasers against the lawful claim title or interest of all
and every person or persons whatever. In testimony whereof the aforesaid William
Polk hath hereunto set his hand and affixed his seal the day and year first above
wirtten.
