Deed from Tully R. Wise & wife to John Wise 12 May 1801.

This deed made the twelveth day of may in the year of our Lord one thousand eight hundred & one between Tully R. Wise and Mary his wife of the County of Northampton of the one part and John Wise of the County of Accomack of the other part Witnesseth that the said Tully R. Wise and Mary his wife for and in consideration of the sum of Seventy pounds four Shillings current money of Virginia to them in hand paid by the said John Wise at & before the execution hereof the receipt of which is hereby Acknowledged, have granted bargained & sold and by these presents do grant bargain and sell unto the said John Wise, his heirs and assignes forever a certain piece of land laying & being in the county of Accomack and bounded Northerly by the lands of said John Wise Easterly by the lands of Charles Snead and Mikell Bonwell junior & Southerly & westerly by the lands of William Wise the same containing by survey nineteen and one half acres be it mor or less it being the whole of that piece of land lying in the woods, which was devised th the said Tully by his father, together with the reversion and reversions, remainder & remainders, rents issues and profits and all and singular the rights, members priviledges and appurtenances to the same belonging or in any wise appurtaining to have & to hold the sd land and appurtenances to him the said John Wise & his heirs and assigns forever, and to or for bo other use, Intent or purpose whatsoever but to the proper use and behoof of the said John Wise his heirs and assignes and the said John Wise his heirs and assignes, and the said Tully R. Wise for himself his heirs, Executors and administrators doth hereby warrant and agree with the said John Wise and his heirs and assigns that he the said Tully R. Wise the afsd land and appurtenances to his the said John Wise & his heirs & assigns against the lawfull claims, demands ro whatever of all and every person or persons whatsoever will warrant and forever defend, In testimony Whereof the parties afsd have hereto set their hands and affixed their seals the day and Year afsd.

The Commonwealth of Virginia to William Harmanson, John Upshur & Thomas Parrimore Gentlemen justices of Northampton County greetings. Whereas Tully R. wise & Mary his wife have by their certain Indenture of Bargain and Sale, bearing date the twelveth day of May in the Year of our lord one thousand Eight hundred and one Sold and Conveyed unto John Wise nineteen & half acres of land with the appurtenances lying and being in the County of Accomack and bounded to wit northerly by the lands of the said John Wise Easterly by the lands of Charles Snead and Michl Bonwell & Southerly & northerly by the lands of William Wise and whereas the said Mary the wife of the said Tully R. Wise cannot conveniently travel to our District Court to be holden at Accomack Courthouse to make acknowledgement of the Said indenture therefore we do give unto you or any two or more of you power to receive the acknowledgement of the said indenture, therefore we do give unto you or any two or more of you power to receive the acknowledgement which the Said Mary shall be willing to make before you of the conveyance aforesaid contained in Said indenture which is hereto annexed & we do therefore command you that you personally go to the said Mary and Examine her privily and apart from her said husband Tully R. Wise Husband whether she doth the same for by freely and Voluntarily without his persuasion or threats, and whether she be willing that the Same Should be recorded in our Said District Court and receiver she acknowledgement of the Same, and where you have examined and received her acknowledgement as aforesaid, that you distinctly and openly certify to us there of in our Said Court under you Seale, Sending their there the said indenture and this writ Witness Edmund Bayly, Clerk of our said Court at the Courthouse the 12th day of May 1801 in the 25th Year of the Commonwealth.

By Virtue of this within Commission to us directed we the Subscribers have privily examined Mary Wise the wife of Tully R. Wise in manner as the said Commission requires and have received her acknowledgement of the indenture here unto annexed which said Indenture She acknowledged freely and Voluntarily, without the persuasion or threats of the Said Tully R. Wise her husband and that she was willing the same Should be recorded in the district Court of Accomack County which we do certify to the said Court under our Hands and Seals this 13th day of May 1801.

At a District Court held at Accomack Courthouse the 15th day of May 1801 this Deed from Tully R. Wise & Mary his Wife to John Wise was partly proved by the Oath of Argil Kellam a Witness thereto.
