This Indenture made the 28th day of august 1849 between Richard Evans and Rachel his wife of the County of Accomack in the State of Virginia of the one part and John Marshall of the said County & State of the other part Witnesseth that the said parties of the first part for and in consideration of the sum of One Hundred dollars to them by the said John Marshall in hand paid the receipt whereof is hereby acknowledged by them have granted bargained and sold an by these presents do grant bargain and sell unto the said John Marshall his heirs and assigns a certain tract or parcel of Land containing in the whole about one hundred Acres of which less than One and a half acres are high Land and the balance is marsh be the same more or less and without accountabilty for excess or difiecency in quantity, lying and being in the said County on Smith;s Island and bounded as follows - On the N by the lands of said John Marshall formerly belonging to said Evans, on the E by Tylor's creek on the S by Shanks creek and on the West by Shanks creek To have and to Hold the said tract or parcel of land with the appurtenances thereto belonging to him the said John Marshall his heirs and assigns to the only proper use and behoof of him the said John Marshall his heirs and assigns forever. And the said Richard Evans and Rachel his wife for themselves & their heirs executors and administrators do hereby covenant and a agree to and with the said John Marshall his heirs and assigns against them the said Richard Evans and Rachel his wife and against all persons whomsoever, shall and will by these presents forever warrant and defend. In Witness whereof the said Richard Evans and Rachel his wife have hereunto set their hands and affix there seals the day and year above written.

Accomack County Court Clerk's Office Augt 28th 1849. This Deed form Richard Evans & John Marshall was acknowledged by the said Richd Evans as his act and deed before me in the Clerk's Office this day and admitted to Record
