This Indenture made this xxviith day of July Anno Domi MDCCXLII Between George Parker of Onancock in Accomack County Gent. of the one part and John Smith of the same place Gent. of the other part Witnesseth that the said George Parker in consideration of the love and affection he bears for his children George, Elizabeth and Sarah Ann and for the Advancement of his said Children and also on the further Consideration of five shillings current money of Virginia by the said John Smith to the said George Parker at and before the Ensealing and Delivery hereof the receipt whereof he hereby doth acknowledge Hath granted Bargained & Sold & Doth hereby Grant Bargain & Sell to the said John Smith his heirs and Assigns for Ever all and Singular the land and Tenements and appurtenances which he the said George holds between the Creek of Onancock and Chiconessex and the reversion of all & Singular the lands Tenements and appurtenances which Charles West and Betty his wife hold between the said Creek as the Dower pf the sd Betty To have and to hold the said bargained premises to the said John Smith his heirs and Assigns for ever to the uses intent and purposes herein after mentioned and Declared to wit To the use and behoof the said George the father Party to these Presents for and During the term of his natural life without impeachment of or for any manner of waste and after his decease to the use and behoof of the said George the Son and the heirs of his body Lawfully begotten for Ever and for Default of Such Issue one moiety of the Premises to the use of the said Elizabeth and the heirs of her body Lawfully begotten for ever And the other sd moiety to the use and behoof of the said Sarah Ann and the heirs of her body Lawfully begotten for Ever and in Default of Issue of the said Elizabeth then her moiety to the use and behoof of the sd Sarah Ann and the heirs of her body lawfully begotten for ever and in Default of Such Issue to the only use and behoof of the said George parker the Father Party to these presents his heirs and assigns for ever and no other use or Uses whatsoever and in Default of Issue of the said Sarah then her moiety to the use of the said Elizabeth and the heirs of her body Lawfully begotten for ever and in Default of such Issue to the only proper use and behoof of the said George Parker the father party to these presents his heirs and assigns for ever and no other use or uses whatsoever And this Indenture further Witnesseth that the said George Parker the father and Party to these presents for the further Advancement of his sd Children and the natural love and affection which he bears to them and for further consideration of other five current money of Virginia to him paid by the said John Smith at or before the Ensealing And Delivery hereof the receipt whereof the said George hereby doth acknowledge Hath Bargained & Sold and Doth hereby Bargain and Sell to the said John Smith his heirs Executors Administrators and Assigns these Negro Slaves following to wit - Judith a woman Slave, Bristol, Tom and Edmund man Slaves to have and to hold the said four Slaves & the future Issue of the said woman Slave to the said John Smith his heirs Executors Administrators and assigns to and for the use purpose & intent hereafter mentioned to wit in trust that the said John Smith his heirs Executors Administrators & assigns Shall permit the said George Parker the father party to these presents and his Assigns during the term of his natural life to receive for his and their proper use and behoof the profit of the labour of the said Slaves and of the issue of the said female Slave and retain the possession thereof and Immediately after the Decease of the said George Parker the father party to these presents then upon trust and confidence that the said John Smith his heirs Exrs Administrators and Assigns Shall Assign - Transfer and Convey to the said George Parker the Son the said Elizabeth and the Said Sarah Ann and the Children of said George Parker the son and of the said Elizabeth and Sarah Ann the said four Slaves or Such of them as shall be living and the Issue then living of the said female Slave Equally and in even Shares and Proportions: but the Child or Children of the said son or Daughters as Shall then happen to be Dead Shall be entitled only to the Share which his her or their father or mother would have been entitled to if living Equall to be divided amount Such Children if more of then one and if but one then wholly to that one and if it Shall die during the life of the said George Parker the father Party to these presents then the said four Slaves to Sole use and behoof of the said George the father his heirs and Assigns for ever and no other use or purpose whatsoever and the said John Smith for himself his heirs Executors and Administrators Doth hereby covenant with the said George Parker party to these presents that immediately after the Death of toe said George Parker the Son the said Elizabeth and the said Sarah Ann and all the issue of Each of them during the life of the said George the father Party to these presents he hid heirs Executors Administrators and Assigns will convey to the said George the father Party to these presents the Legall Estate of the said four Slaves or Such of them as Shall then be living and the then living Issue of the said female Slave In Testimony whereof the Partys aforesaid have these presents Interchangeably affixed their hands and Seals this Day and Year first above written
