John Bayly was born in Accomack Co., VA circa 1766. He was the son of Charles and Mary Bayly. John died before 25 December 1837. In Charles Bayly's will on 13 March 1782 in Accomack Co., VA, John was named as an heir. It was probated 24 September 1782 (Nottingham). An abstract of his will reads: "BAILY, CHARLES - 13 Mar. 1782 - 24 Sept. 1782 - To son Thomas all my land in the lower end of the Neck. To son John Baily land beginning at the mouth of Salsburys Gutt & on Finney Creek. To wife Mary land where I live for life. Daughter Susanna Baily. Daughter Sarah Baily. Daughter Nancy Baily, Daughter Peggy Baily, Daughter Betsey Baily. Daughter Mary Baily. Bal. of estate to be sold for debt & the remainder divided between my 6 daughters Wife, son Thomas & John Baily Exrs. Witt: Abraham Outten, Edmond Leatherbury - ln order of Prob: Thomas Baily heir at law to the testator."
John was listed on the personal property Tax List for 1787 (Yantis-Schreiner 98). The record reads: "2 Blacks over 16, 7 Blacks under 16, 4 cows, 8 cattle, two wheeled carriage."
The Procession of 1795, as it originally reads: "Eleventh District Decr 29th 1795 - Lines between John Bayly & William Finney. Lines between John Bayly & Henry Custis..." (Processioners Returns). Whitelaw states: "John Bailey Part. - 1800 - it was surveyed as 242 acres and extended eastward to Leatherbury's Creek" ( 829).
John made a will on 4 September 1837 in Accomack Co., VA. It was probated 25 December 1837 (Miles 34). An abstract of his will reads:
BAYLY JOHN SR. 4 September 1837 - 25 December 1837 - To nephew William Wesley Melvin the land occupied by Edward Chandler containing 80 acres adjoining the land of William Finney & with the priviledge of getting firewood. ... To my sister Margaret Bayly all the rest of my land & ... except my slaves & at her death to my nephew John J. Bayly. To my niece Catherine Melvin the wife of Rev. Avery Melvin, $500. To nephew John B. Melvin, son of Avery & Catherine Melvin £1,000 Virginia currency. To John, the son of my nephew John J. Bayly, $500. Slaves James & Darkey to be free at my death with a legacy to James of $125 & to Darkey $75. After the death of my sister Margaret, the rest to my heirs at law. Sister Margaret Bayly & my nephew John J. Bayly & my friend Col. Edward S. Snead Extrs. Witt: Levin S. Joynes Jr. John D. Tyler, Isaiah N. Bagwell. Prob: Thomas W. Finney, William C. Boggs & William D. Seymour securities.
There is no record of a marriage for John Bayly. He did not mention a wife nor children in his will.
