In the Name of God amen I James Broadwater Senr of Accomack County State of Virginia being Sick and Weak of Body but of Sound and disposing mind and memory to make and ordain this my last will and Testament revoking all other Will or Wills heretofore by me made in manner and form following To witt
I Lend unto my wife Betty Broadwater during her natural life or Widowhood the whole of my Plantation whereon I now live and also during the above said time the following Negroes Viz Negroes Toby Peter Joshua Sabreugh and all her Children Item I give and bequeath unto my Son George Broadwater after the death or Intermarriage of his Mother the lands on the South Side of the plantation where on I now live beginning at a white Oak Standing Near to Dixon Halls line and against the end of a Ditch Running through the Plantation with Said ditch easterly to the north Side of the old Orchard to a Persimmon tree at the North Side of Said Orchard Thence with a ditch on the other Side of Said Orchard Strieght with the ditch Easterly to Corbin line provided he the said George Broadwater will pay unto my daughter Rachel Cutler the Sum of Thirty Three pounds Current Money before he shall be entitled to take possession of the Said lands and also to give my son Harry the priviledge of claiming his land here after given him by the Ditches as they now stand and also Timber Sufficient to keep up Harrys part of line fence from Georges part of land during their lives to him and his Heirs and assigns for ever and also after the death or intermarriage of his Mother I give my said Son George Negroes Toby & half of Sabrough & half of her interest and also the Balance due me from my said after paying the above Sum to my Daughter Rachel Cutler to him & his Heirs and assigns for ever
Item I give and bequeath unto my Son Henry Broadwater after the death or intermarriage of his mother all the Remaining part of my Plantation whereon I now live as above discribed for the division between my Said Sons George & Henry that is to say beginning at a Whte Oak Standing near Dixon Hall line and against the mouth of a Ditch running trough the plantation with the ditch easterly to the north Side of the old Orchard to a persimmon tree, thence with a ditch on the east Side of land Orchard Strieght to Corbins Line easterly, containing all all the Balance of the land to the North Side of Said Plantation from the division line as above discribed with a priviledge of Drawing [-----] land by the ditches as they now Stand through my Son Georges part afsd Plantation also Timber Sufficient to Keep up his part of the line Fence from my son Georges part of the land during the term of their lives (meaning the fence) also at the death of his mother I give him Negroes Peter, and half Negro Scarburgh & half her increase to him and his Heirs and Assigns for ever
Item Its my Will and desire that if either of my sons George or Henry Should die Intestate and without Issue in that Case I give the part belonging to either of my sons so dying unto my daughter Rachel Cutler during the term of her natural life and after her death unto my Surviving Son & his heirs and assigns for ever
Item I give bequeath unto my Son James Broadwater Negroe Jacob & Negro William to him and his heirs and assigns for ever
Item I give and bequeath unto my Grandson Theosphis Milburn One Negor Boy named Scott and one Cow & Calf to his and his Heirs and assigns for ever
Item I give and bequeath unto my Son in law Robert Parker Ten Barels Corn the first out of the Crop
Item I give and bequeath unto my Grand son James Parker one negro lad named Major to him & his heirs and Assigns
Item I give and bequeath unto my Grand Children Walter Sussanah and Gilbert Parkers each one Heifer a piece about two years Old
Item I give and bequeath unto my Daughter Nancy Finney after the death of her mother a Negro man named Joshua to her and her heirs and assigns
Item I give and bequeath unto my Wife Betty Broadwater one half the Crop made After taking Out Parkers Ten Barels Corn and also One third of the Balance of my Estate in lieu of Dower
Item I give and bequeath unto my Daughter Rachel Culter the Sum of thirty Three Pounds to be paid by my son George, One Negroe Man named Levin & Negro Woman named Easter during her Natural life and then with all the Other Property given her by this will to be equally divided between all her Children & thier heirs and Assigns for ever
I give and bequeath unto my son James Broadwater, my Daughter Rachel Culter & my Daughter Nancy Finny all the residue of my Estate not before divised to be equally divided between them their Heirs & assigns for ever
Item I hereby Nominate and appoint my wife Betty Broadwater Executrix to this my last Will & testament In testimony whereof I have hereunto Set my hand and Seal this the 16th day of Septr 1795

At a District Court held at Accomack Courthouse the 18th day of May 1801 This writing purported to be the last Will & Testament of James Broadwater decd, now offered for proof by the Executrix therein named was proved to the satisfaction of the Court by the Oaths of Walter Bayne & Maddox Fisher Witnesses thereto and ordered to be recorded
