Last Will and Testament of James Drummond - 1874 Proved 29 March 1875 - Typescript in the Clerk's Office
NOTE: Spellings have not been changed.
In the name of God, Amen. I, James Drummond of the County of Accomac and, State of Virginia being of sound and disposing mind and memory, do make, publish and ordain this instrument of writing as and for my last will and testament, hereby revoking any other will or testament heretofore made by me at any time.
First. - I direct that all my just debts shall be paid out of my estate as soon after my decease as may be convenient, in the event that I should then owe any debts.
Second. - I give and devise to my two Children, Francis R. and Harriet A., and to their heirs forever, to be equally divided between them, my farm situated in Slutkill Neck, in the county aforesaid, containing one hundred and thirty four acres, more or less, and which was purchased by me from William S. Rodgers and Others. In order that an equal division of the said farm may be made between my Son Francis R. and my daughter Harriet A., I hereby direct that my said son and said daughter shall each choose one intelligent, capabel and disinterested person, who shall divide said farm as equally into two shares as may be done, having regard to the improvements thereon and the quality and quantity of land. In case the two persons so to be chosen shall be unable to agree upon a division of the said farm they shall choose one more such person, whose division of the said farm shall be binding upon my said son and daughter. Whne the said farm shall have been divided, as herein directed, my son, Francis R. shall have his choice of shares, and my daughter Harriet A., shall have the other share.
Third. - I hereby appoint my son, Henry C. Drummond, executor of this, my last will and testament.

At a Court held for the County of Accomack, on the 29th day of March 1875. This Last Will and Testament of James Drummond Senr:, deceased, was proved by the oaths of William C. Waters and Edward T. Nock, witnesses thereto, and ordered to be recorded; and on the motion of Henry C. Drummond, the Executor in the said Last will and Testament named, taking oath and giving bond according to law in the penalty of Three thousand Dollars ($3,000.), with Charles P. Finney, James C. Drummond and Littleton T. Boggs, is ordered to be recorded.
