I William M. Duncan late of the County of Accomack and State of Virginia do constitute and appoint Smith Melson in case of my death to take my property in his Possession and to sell the said property as he sees proper and and pay my just Debts that he is security for and the Ballance of my property to keep for my friends. As Witness my hand and Seal this 14th day of October 1799

At a District Court held at Accomack Courthouse October 19th 1799. This writing purporting to be the last will and Testament of William M. Duncan decd now offered for proof by the Executor therein named was proved by the Oaths of James Smith and Robert Russel Witnesses thereto and ordered to be recorded. On the motion of Smith Melson certificate is granted him for obtaining a probate of the said will he having taken to Oath of an Executor and together with Thomas Bayly and John Custis (BS) his Securities entered into and acknowledged a Bond in the Penalty of three hundred pounds with condition according to Law
