In
the name of God Amen I John Kelly of the County of Accomack in Virginia being sick
& weak in body but of perfect strength & memory thanks be to God for it doe think
fitt to make this my last will and Testament revoking & making void all wills & testaments
by me formerly made desireing all my Just Debts may be paid & satisfied my soul I
commend to my maker & redeemer my body I commit to the Earth with decent burial at
the discretion of my Executors hereafter named as for what Estate it hath been pleased
God to bestow upon me I give & bequeath as followeth
Viz Item I give & bequeath
unto my two sons Edmund Kelly & Joseph Kelly & their heirs for Ever all my Land on
the South side of the Ledgey branch next to the land of Bayly Hinman Item I give
unto my two sons Daniel Kelly & David Kelly and their heirs for Ever my plantation
whereon I live with all ye Land on this side the said branch Item I give & bequeath
unto my two sons George Kelly & Dennis Kelly & their heirs for Ever all my land from
Edward Bolls line to the Mash by Timothy Coes old saw pitt Item
I give unto
my son John Kelly & his heirs for ever my old plantation with all the remaining part
of my Land
Item I give unto my daughter Sarah Kelly my best feather bed &
furniture & best cow & calf. Item I give unto my two sons John & George Kelly Each
of them a bed now in their possession Item I give unto my son Edmund Kelly my young
black Horse Item I give unto my son Thomas Kelly Seven spa Sows & barrows & one breeding
sow Item all the rest of my Estate I give unto my two Sons Daniel & David Kelly after
my debts are paid Item my will is that my Sons shall not sell nor dispose of any
part of their Land above mentioned Except to each other Item my will is that my Son
John Kelly with the assistance of John Johnson shall be my sole Executor to this
my last will & Testament where unto I set my hand & seal this sixth day of April
one thousand Seven hundred twenty four John Kelly

The within
last will & Testament of John Kelly deceased was proved in open Court of Accomack
County by the Oaths of John Johnson Elias Bell & Charles Pringle Witnesses to the
same June the 2nd 1724 which the court Admitted to Record
