In the name of God Amen I Thomas Medcalf of Accomack county being in my perfect senses and understanding doth make this my last will and Testament in manner and form following Viz

Imprimus I give and bequeath unto James Ross the son of Betsy Ross decd my Negro man named Jacob, the second choice of my feather Beds & furniture two chests one that was his mothers and my Cloaths Chist together with my Cloaths and my Fiddle

Item I give and bequeath unto my Daughter Polly Medcalf & her heirs all the rest and residue of my estate real and personal after my Just Debts are paid, upon this express condition that she my said Daughter Cloath maintain and send to school the above said James Ross so as to give him a common English Education until he is of Sufficient age to bind out and them for him to be bound out, and to be no further charge to her

Item my will and desire is that in case my Daughter Polly Medcalf should die without leaving issue surviving her that then and in that case I give and bequeath unto the said James Ross and his heirs all my said Lands and other Estate

Lastly I nominate and appoint my Friend Edmund Bayly my Executor to this my last will to see the same duly performed In Witness whereof I have hereunto set my hand and Seal this Twenty first day of May One thousand eight hundred and three

At a District Court held at Accomack Courthouse 19th October 1803 the said last Will and Testament of Thomas Medcalf decd now offered for proof by the Executor therein named was partly proven by the Oath of Ebern Bird a witness thereto

At a District Court held at Accomack Courthouse 20th October 1803 the said last Will and Testament of Thomas Medcalf decd now offered for proof by the Executor therein named was further proven by the Oath of Samuel Barnes a Witness thereto and ordered to be recorded. On the motion of Edmund Bayly certificate is granted him for obtaining a probate of the said Will he having taken the Oath of an Executor and together with Thomas Bayly Senr his Security entered and acknowledged a Bond with the Penalty of two thousand Dollars with Condition according to law, which is ordered to be recorded
